Product Warranty & Legal Guarantee - Europe

This page applies to TRIAX products purchased through the TRIAX Lubricants European store and supplied by WESTONE S.R.L. to customers in Europe.

Legal Guarantee of Conformity

Consumers purchasing products through our European store benefit from the legal guarantee of conformity provided under applicable European Union and national consumer protection laws.

Under EU consumer rules, consumers are entitled to a minimum 2-year legal guarantee from the date of delivery for goods that are defective, do not conform to the sales contract, or do not perform as reasonably expected based on the product description.

Depending on the circumstances, consumers may be entitled to remedies from the seller free of charge, including replacement, repair where applicable, a price reduction, or reimbursement in accordance with applicable law.

National legislation in the consumer's country may provide additional or longer protection.

Your statutory consumer rights are not affected, restricted, or replaced by the TRIAX Commercial Limited Warranty described below.

TRIAX 5-Year Commercial Limited Warranty

In addition to the statutory rights available to consumers under applicable European and national law, TRIAX LLC provides the following commercial limited warranty for eligible TRIAX lubricant products.

TRIAX LLC ("TRIAX", "we", "our", "us") warrants that eligible TRIAX lubricant products ("Products") are free from defects in materials, formulation, and manufacture for a period of 5 years from the original date of purchase, provided that the Products are properly stored, handled, and used strictly in accordance with the applications, specifications, and recommendations stated on the applicable TRIAX product label and Product Data Sheet.

This commercial warranty applies to eligible genuine TRIAX products purchased through TRIAX Lubricants Europe or an authorized TRIAX distributor and used under normal operating conditions.

This commercial warranty is provided in addition to, and does not affect, the consumer's statutory legal guarantee or any other mandatory rights available under applicable law.

What the TRIAX Commercial Limited Warranty Covers

TRIAX warrants that eligible lubricant products are free from defects in materials, formulation, and manufacture and are suitable for the applications and specifications expressly identified by TRIAX on the applicable Product Data Sheet and product label.

The commercial warranty applies when the TRIAX lubricant has been properly selected, stored, handled, and used according to TRIAX recommendations and the applicable requirements of the original equipment manufacturer (OEM).

What the TRIAX Commercial Limited Warranty Does Not Cover

  • Products that were not originally packaged by TRIAX or an authorized TRIAX packager, or that were not supplied through TRIAX or an authorized TRIAX distributor.
  • Products that have been altered, repackaged, diluted, or contaminated after leaving the authorized distribution chain.
  • TRIAX lubricants used together with incompatible or unauthorized lubricants, additives, chemicals, or other substances where such use contributed to the claimed damage or failure.
  • Contamination caused by improper handling, storage, filtration, dispensing equipment, environmental exposure, or other circumstances occurring after delivery.
  • Damage resulting from defective, improperly maintained, modified, neglected, abused, or mechanically deficient equipment.
  • Pre-existing equipment defects, damage, or conditions unrelated to the TRIAX lubricant.
  • Normal equipment wear and tear.
  • Normal consumption, depletion, or degradation of lubricant occurring during ordinary use or as part of a normal service interval.
  • Damage resulting from failure to follow applicable OEM maintenance requirements, lubricant specifications, service procedures, or drain intervals.
  • Use of a TRIAX lubricant outside the applications, specifications, or operating conditions expressly recommended by TRIAX or the applicable OEM.
  • Products used for racing or competition purposes unless the applicable TRIAX product is specifically designated for such use.
  • Claims where information, samples, or relevant components reasonably required to determine the cause of the alleged failure cannot be made available for examination, where such examination is reasonably necessary.

The exclusions above apply only to the TRIAX Commercial Limited Warranty. They do not exclude or restrict any mandatory statutory rights available to consumers under applicable law.

What TRIAX Will Do for a Covered Commercial Warranty Claim

If an eligible TRIAX lubricant is confirmed to have a defect in materials, formulation, or manufacture covered by this commercial warranty, TRIAX LLC may:

  1. Replace the affected TRIAX lubricant or reimburse its purchase price; and
  2. Where the investigation establishes that a covered defect in the TRIAX lubricant directly caused damage to equipment components, TRIAX LLC may, at its option and cost and subject to the terms of this commercial warranty, arrange for the repair or replacement of the directly affected components.

These remedies relate to the TRIAX Commercial Limited Warranty only and do not affect any separate remedies or rights available to consumers under applicable European or national law.

How to Make a Warranty Claim in Europe

If you believe a TRIAX lubricant may be defective or may have contributed to an equipment problem, please contact TRIAX Lubricants Europe as soon as reasonably possible after becoming aware of the issue.

Please contact us through our online contact form before sending any lubricant samples, equipment components, or other physical materials.

To help us evaluate the claim, you may be asked to provide:

  • Your TRIAX order number or other proof of purchase.
  • The exact TRIAX product name and package size.
  • The product batch or lot number shown on the container, where available.
  • The make, model, year, and relevant specifications of the vehicle or equipment.
  • Total accumulated mileage, kilometres, or operating hours, where relevant.
  • The mileage or operating hours at which the TRIAX lubricant was installed.
  • A description of the issue or alleged failure.
  • Relevant photographs, service records, maintenance records, diagnostic reports, or oil-analysis reports, where reasonably required.
  • Information regarding previous repairs or relevant mechanical conditions.
  • Documentation from the OEM or repair facility, where applicable.

Lubricant Samples and Failed Components

Where reasonably possible, customers should preserve a representative sample of the lubricant involved in the alleged failure and retain relevant failed components until advised otherwise.

If a lubricant sample, component, or additional technical inspection is required, TRIAX Lubricants Europe or TRIAX LLC will provide instructions regarding collection, packaging, inspection, and shipping.

Please do not send lubricant samples, damaged components, or other materials to the United States or to our European warehouse without prior authorization.

Investigation of a Commercial Warranty Claim

TRIAX LLC, WESTONE S.R.L., their insurers, laboratories, technical representatives, or other authorized specialists may request information reasonably necessary to determine the cause of the alleged failure.

The customer may be asked to cooperate with the technical investigation and, where reasonably necessary, make relevant lubricant samples or affected components available for inspection.

A request for technical information or inspection does not limit any mandatory statutory rights available to consumers.

OEM Warranty Claims

If the affected vehicle or equipment remains under an OEM warranty, the customer may also be required to notify the applicable vehicle or equipment manufacturer or authorized service provider.

If an OEM warranty claim is denied specifically because of the use of a TRIAX lubricant, please provide a copy of the written warranty decision where available so that TRIAX can review the matter.

Relationship Between the Legal Guarantee and the TRIAX Commercial Warranty

The statutory legal guarantee and the TRIAX Commercial Limited Warranty are separate.

For products sold through the European TRIAX store, WESTONE S.R.L. remains responsible for the consumer's statutory rights as the seller in accordance with applicable consumer protection legislation.

The additional 5-year TRIAX Commercial Limited Warranty is provided by TRIAX LLC as the commercial guarantor, subject to the terms stated on this page.

Nothing in this commercial warranty may be interpreted as excluding, restricting, suspending, or otherwise limiting rights or remedies that cannot legally be excluded or limited under applicable European Union or national consumer protection law.

Commercial Warranty Liability

This commercial warranty covers only claims falling within its stated terms and conditions.

Nothing in this warranty excludes or limits liability where such exclusion or limitation is prohibited by applicable law, nor does it exclude or limit any mandatory statutory rights or remedies available to consumers.
